Pepperell Planning Board Advances Rules Overhaul, Flags Enforcement Gaps

PEPPERELL — December 5, 2022 — Pepperell Planning Board spends three hours on draft rules overhaul, continuing work to December 19. The five-member board, meeting remotely on December 5, worked line by line through roughly 16 of more than 85 pages of proposed new rules and regulations for special permits and site plan reviews, flagging questions on enforceability, redundancy, and applicant clarity throughout. Chair Al argued repeatedly that purpose language is repeated too many times across sections and that requirements such as grounds maintenance schedules, building repainting timelines, and lease disclosure go beyond what the board can realistically enforce — "when times get tight, I just see it stretching the authority of the planning board." Conservation Commission member Paula Terrasi successfully urged the board to strike a requirement for pervious paving materials after confirming state stormwater standards now treat that technology with significant uncertainty. A by-right restructuring of the town's open space residential development process was floated by Chair Al as a future agenda item, with Terrasi cautioning that "there's a lot that we have to consider." The board also unanimously continued its Scotch Pine Farm Way as-built review, with applicant representative Jeff Chabot reporting the fire truck turnaround, gravel shoulder, and shed removal items substantially complete pending a final engineer's submission.
