Pepperell Planning Board approves Tucker Street three-unit development, sets $50,904 subdivision bond.

PEPPERELL — August 21, 2016 — Pepperell Planning Board approves three-unit Tucker Street development and accepts a $50,904.75 performance bond for the River Road Open Space Residential Development subdivision. The board voted four to one — with member Chuck abstaining — to approve the site plan for Small Court, SP2016-02, at 26 Tucker Street for applicants Lisa and Peter Small, after consultant Kenneth Laney of Cornerstone Land Consultants presented revised plans addressing engineering comments on stormwater, sewer layout, and snow storage. The board added a condition requiring dark-sky-friendly lighting with 76-degree luminaire cutoffs after abutters raised glare concerns at a prior hearing. On the River Road OSRD, the board accepted the bond covering remaining paving, seeding, signs, and as-built plans, but heard that a post-approval change to Pepperell Water Division regulations now bars water services from crossing properties by easement — a shift Town Counsel concluded is not subject to the statutory plan-freeze protections of MGL Chapter 48 or Chapter 41, leaving most interior lots facing wells and potentially forcing lot-line modifications that will require board review.
