The commission voted unanimously at its March 25 meeting to continue a public hearing on a notice of intent filed by Kevin Smith for a new septic system and grading on a 53-acre Brookline Road parcel, after the Massachusetts Department of Environmental Protection declined to issue a file number pending an explanation of a pond constructed on the property during the COVID-19 pandemic without a conservation filing. Engineer Jack Maloney of Beals and Thomas told commissioners that the proposed leach field sits approximately 1,409 feet from the nearest abutter well — more than 14 times the state minimum — and four feet above the groundwater table, but two condo residents at 201 Brookline Road attended to raise concerns about their shared well, prompting Chair James Gates to direct them to the Board of Health. The commission separately voted unanimously to issue a standard order of conditions for 198 North End Road and a conditional certificate of compliance for 75 Pierce Road, the latter held pending photographic proof of silt fence removal. Member Sandra Lord reported that Pepperell's Community Preservation Act surcharge has generated a projected $191,000 in first-year revenue, with application guidelines still under development and no funds spendable until 2027.
