Pepperell Planning Board Eyes December Town Meeting for Zoning District Definitions
PEPPERELL — August 4, 2025 — Pepperell Planning Board votes to continue zoning overhaul hearing to August 18, targeting December Town Meeting for a first article. The board spent its August 4 session debating how to scope a long-running zoning bylaw revision, settling on a strategy of adding written definitions to the town's currently undefined zoning districts — an omission the board's staff planner called "pretty unusual" among Massachusetts communities — paired with a short list of roughly 10 to 12 high-priority table-of-uses changes. The staff planner warned that the absence of definitions creates legal exposure, noting that courts reviewing permit denials routinely ask "how does the town actually define your residence?" and that without an answer, a denial based on incompatibility "would be shaky." Members cited the town's adaptive reuse overlay district as a cautionary precedent: designed to allow Park Street historic homes to convert to inns, its core purpose was stripped at a prior Town Meeting, leaving a district that applies only to municipal and church buildings. Board members were assigned to review draft definitions and submit individual written comments before the August 18 meeting, with the staff planner noting he will be abroad the intervening week and will have only Sunday to compile input before the hearing.
